Severance Agreements

An employee facing termination or considering resignation is often in a position to consider a Severance Agreement. There is no law in Wisconsin which requires employers to offer severance pay to its employees, but an employer which does offer such pay will often have to comply with various state and federal statutory provisions. This is particularly true if the Severance Agreement requires the employee to release certain claims that he may have or limits the employee's ability to obtain other employment.

Severance Agreements are often subject to negotiation and an employee who is presented with a proposed agreement can generally benefit by consulting with an attorney who is familiar with these agreements. In some cases, it may be in the employee's interest to approach the employer about entering into such an agreement. Successful negotiation of such an agreement will often require finesse. An attorney who knows the benefits and pitfalls of these agreements can often be of great assistance.
