SET REALISTIC GOALS.
One of the first questions that I ask employees who are seeking legal help is
what they are hoping to obtain. Many people are surprised by this question. Some
have been consulting with lawyers for years about the problem and yet have never
been asked this question. The truth is that both you and your lawyer need to
know what you want to accomplish. When I interview clients, I will often tell
them what type of legal relief they can expect based upon the type of claim that
they have. Before I will agree to represent anyone, I usually have to be
convinced that the client's goal is reasonable and attainable. For instance, if
you are seeking monetary relief, I will need to know what dollar amount you
realistically expect to obtain. If, for instance, you tell me that you will take
nothing less than $1 million for a claim that has a realistic value of $40,000,
I will probably refuse to represent you -- no matter what you will offer to pay
as fees. This is because I know from the outset that I will never be able to
satisfy your expectations. I am constantly amazed when I talk with employees who are litigating cases without any idea of what they want. Litigation is a means to an end -- it is not a goal in and of itself. I am unable to recommend a course of action unless I have some idea where the case should be headed. Your objective can change as the case progresses, but you should always know how the case can be resolved at any given time. Most cases settle. They can settle at any stage of the litigation -- even after a judgment. You cannot win your case unless you know what constitutes winning. Employees who do not set realistic goals lose their cases. The legal system is set up to punish those who are unreasonable.
