LIVE YOUR LIFE.  Losing a job or being treated unfairly at work can be a traumatic. Many employees are emotionally devastated by the experience. They turn to the legal system for justice and relief. Unfortunately, justice can take time and is often elusive. The type of relief you obtain can be less than you initially hoped.  The legal system generally does not compensate you for the time, aggravation, and mental anguish you experience because of the legal process itself.

There is no such thing as an employment case that cannot be lost. These are all difficult cases for employees to win. Since the employee almost always has the burden of proof, the case is lost if the fact finder does not know who to believe or if the fact finder believes the employer. The amount awarded as damages can be reduced for all sorts of reasons. The truth is that very few people return to a job from which they have been fired.

Due to the uncertainties that exist in the legal system, no one should allow a legal case to become the central focus of his or her life.  Your case should be a peripheral matter that you are pursuing with the hope that you may obtain some relief. Although your chance of success is probably greater than winning the lottery, you will be much happier if you treat your case something like a lottery ticket rather than the top priority in your life.  Interestingly, the most successful employee litigants tend to be those who have moved on to other jobs and have learned to put the unfair treatment they have received behind them. Jurors and judges like to reward those who are hard working and forward looking rather than those who are wallowing in despair and waiting around for a windfall recovery.

This may seem like unusual advice from an attorney who wants to be hired to represent you in an employment case. But I really do not want to represent you if this case will become the central focus of your life.  It makes my job much more difficult and diminishes your chances of success.
