FIND THE RIGHT LAWYER FOR YOU.  Unlike other areas of law where changes are often infrequent and gradual, employment law can change often and abruptly. New employment laws and regulations are being constantly proposed and enacted. Courts and agencies have in recent years rejected prior precedents and announced new interpretations of laws that have both created and invalidated claims.  Representing employees in this challenging environment requires a lawyer that is knowledgeable, experienced, and creative.

Good employment lawyers will not take cases that cannot be won. This is because most attorneys who represent employees realize that they will not be fully paid unless they win. They know that workers who have recently lost a job are usually not in a position to pay thousands and thousands of dollars in attorney's fees.  Good employment lawyers will not take bad cases just to earn a fee.

Finding the right lawyer can be difficult. If the lawyer does not have much experience with employment cases, you should be wary since this is not an area of law which is easily learned. If the lawyer will only represent you on an hourly basis, you should also be concerned. If the lawyer truly believes that you have a case, he or she should be willing to work with you to make at least some of the fee contingent upon your success. If the lawyer expects to be fully paid regardless of whether you win or lose, there is a good chance that you will run out of money before the case is fully litigated. Lawyers who only work on an hourly basis will dump you as client when you can no longer pay the bill.
